Legal Basis for data processing
In certain instances, we will collect and use your PII by relying on the ‘legitimate interest’ legal basis. This is because when you, for instance, request to receive services or products from The Recks, we have a legitimate organisational interest to use your PII to respond to you and there is no overriding prejudice to you by using your PII for this purpose. This is also the case where we process any product orders for you and where we need to take steps to protect our network security or mitigate risk of fraud.
In the main, we will rely on obtaining your consent for our use of your PII. This is the case where we seek to obtain your consent to receive our marketing, i.e. e-mail, SMS.

We will not use your PII for marketing purposes if you have indicated that you do not wish to be contacted by us for such purposes. However, we will retain your details on a suppressions file to help ensure that we do not continue to contact you for marketing.

We ensure that there are appropriate and technical controls in place to protect your personal details. Information is held securely and routinely monitored. Access to information is restricted to the data controller.
Disclosures of your personal identifiable information
We will not share your data with third parties unless we are obliged to disclose PII by law, or the disclosure is ‘necessary’ for purposes of national security, taxation and criminal investigation, or we have your consent.
In the event that we undergo re-organisation or are sold to a third party, you agree that any PII we hold about you may be transferred to that re-organised entity or third party.
Keeping your personal identifiable information
We keep your PII only for as long required to operate our services in accordance with legal requirements, tax and insurance purposes. For marketing, this may be until you withdraw consent. However, we will retain your details on our suppressions file to help ensure that we do not continue to contact you.
